August Term, 1998 Argued: October 14, 1998 (Petition for Rehearing) Appeal from a judgment of the United States District Court for the Southern District of New York (Charles L. Brieant, Jr., Judge), granting summary judgment to Defendants by dismissing Plaintiffs-Appellants' claims under the United States Constitution and 42 U.S.C. § 1983. This Court initially reversed the district court's decision in an opinion dated March 17, 1998. Defendants-Appellees then petitioned for rehearing. The petition was granted, and a rehearing was conducted on October 14, 1998. We now affirm the district court's decision granting summary judgment to the Defendants.
